The governing law

All food business operators (FBO) in India are eligible to apply for a food license from the Food Safety and Standards Authority of India (FSSAI), a legal body.

Every food business operator in the nation is required by Section 31(1) of the Food Safety and Standards Act, 2006 to hold a license from the Food Safety & Standards Authority of India (FSSAI). The Food Safety & Standards (Licensing and Registration of Food Business) Regulations, 2011 govern the FSSAI licensing and registration process and standards.

FSSAI License/Registration

Depending on the business categories, turnover, and production capacity, FSSAI registration is granted. FBOs can obtain essential, central, and state licenses based on installed capacity and turnover.

FSSAI Registration

Petty food makers or FBOs with less than Rs. 12 lakhs in revenue must register with the FSSAI unless they are exempt from compulsory licensing.

FSSAI License

Businesses with a revenue of more than 12 lakh or FBOs involved in the processing and production of food are required to hold an FSSAI license. There are two sorts of FSSAI licenses: Central and State licenses. The FSSAI license has 14 digits total, the first of which begins with 1. Depending on the size of their company, FBOs must obtain either a state license or a central license.

State license

Manufacturers, merchants, marketers, transporters, and processors of medium size must get an FSSAI state license from the state.

The FBO is classified as a medium-sized FBO and needs to have a state license if its yearly turnover is more than Rs. 12 lakh but not more than Rs. 20 crore.

When the FBO’s yearly revenue exceeds Rs. 20 crore, it is required to obtain a central license.

Central license

A large-scale company that processes, ships, manufactures, or engages in international trading in food goods must apply for an FSSAI central license. A FBO that generates more than Rs. 20 crore in revenue annually qualifies as a large business and needs to apply for an FSSAI central license from the Central Government.

The FSSAI license or registration's validity

The repercussions of operating without an FSSAI registration

Except for those who are exempt under sub-section (2) of section 31 of this Act, engaging in any food-related business without a valid FSSAI registration or license, either directly or through a representative, may result in penalties. These activities may include manufacturing, selling, storing, distributing, or importing food products without the necessary authorization.

A fine of up to five lakh rupees and a jail sentence of up to six months are the possible consequences for such behavior.
